Contact an experienced defense attorney at the Weingart Law Firm in Tempe if you have been arrested for DUI or any other alcohol-related traffic charge. Our attorneys combine a comprehensive knowledge of Arizona’s complex DUI laws with extensive experience in the investigation and defense of drunk driving charges.
In his 30-year career, AV-rated* Phoenix DUI defense lawyer Mark Weingart has served as a prosecutor, judge, and defense attorney in drunk driving cases. He is a founding member of the National College of DUI Defense as well as a nationally recognized authority on DUI defense techniques. He is also Board Certified in criminal law by the Arizona Board of Legal Specialization. Mark Weingart and his associates can help you avoid the severe consequences of a conviction under Arizona’s harsh drunk driving laws.
Ideally, we will advise clients between the time they’re pulled over by an officer and the time they decide whether to provide a blood sample or breath sample. In Arizona, you have the right to refuse a breath test until you are given the chance to talk to a lawyer. It’s important to remember that you must clearly state your intention to do so to the arresting officer.
Otherwise, we will take the facts where we find them and defend our clients with all of the resources at our disposal in cases involving the following charges and considerations:
The penalties for drunk driving in Arizona have become so severe that nowadays nine months of driving on an ignition interlock device, that not only checks your breath but also monitors your location, is in many cases considered a favorable outcome.
Our clients come from all walks of life in Greater Phoenix and all over Arizona. We represent many licensed professionals, such as pilots, nurses, teachers, and even attorneys, whose professional standing can be damaged or ruined by a DUI conviction. We’ll approach your defense with a full awareness of the risk that a conviction would present for your occupational license, and we will help you deal with your licensing board while defending you on the DUI charges. Even for a first-time offense at a blood alcohol level of .08 percent, a DUI arrest can carry serious penalties, including mandatory jail time, an automatic license suspension, and a hefty fine. There is also the Ignition Interlock Device requirement. Conviction on a DUI charge also counts as an 8-point moving violation against your driver’s license and your auto insurance premiums will increase accordingly. Recent law changes allow us to argue that on a regular DUI (not extreme) the time spent with the officers at arrest, equates to a day, eliminating the need for further jail time if convicted.
For extreme DUI with elevated blood alcohol content of .15 percent and up, a charge of aggravated DUI, or any repeat DUI offense within seven years, the penalties get significantly worse. You’ll need an experienced DUI defense attorney to answer your questions, investigate the circumstances of your case, and go to work to protect your driver’s license and your driving record.
Although the legislature eliminated the right to a jury trial for first offense regular (not extreme) DUI in early 2012, that is expected to be repealed very soon. One very important function of your Lawyer is to know and understand the blood and breath alcohol defenses.
Our experience and focus on DUI defense can represent a significant advantage to you in defeating an Arizona drunk driving charge on the facts, on constitutional grounds, or on collateral attack. If you contact us soon enough, we can request a DMV hearing to obtain a restricted license (DUI “work permit”) and avoid the immediate effect of the automatic suspension. We will make a careful examination of the circumstances of your arrest, the police reports, the lab reports, and any field sobriety tests to spot the weaknesses in the prosecution’s case.
With more than 500 jury trials to his credit, Arizona DUI defense attorney Mark Weingart has the knowledge and experience necessary to present the most persuasive defense possible under the facts in your case. Contact the Weingart Law Firm in Tempe for a free consultation about your DUI charges.
